Standard Photoshoot Terms & Conditions

1. Booking Fee – A booking fee is required at the time of booking, together with the signed terms and conditions. This is subtracted from your balance and is often the full price of the photoshoot. It is non-refundable or non-transferable in the event of cancellation. Shoots that are postponed to a later date can retain their booking fee provided the photographer is available on the new date, however the client maybe be subjected to prices correct at the rescheduled date.

2. Balance Payments – Any balance is to be settled no later than one full month prior to the photo shoot session. Payment options are either by cheque, electronic transfer, or credit / debit card. Any products ordered must be paid for in full upon the order placement. If the client uses the automated split payment system, products may not be placed with the manufacturer until the payment schedule is complete.

3. Photographer(s) – The principal photographer will be Trevor Lucy and will be the only photographer allowed to attend for financial gain. If the session is in the office studio, the client(s) or guests of the client, are not allowed to record their own digital media.

4. Images – All image sizes are nominal. The photographer will provide what they deem to be a pleasing colour balance but cannot guarantee an exact colour matching owing to colour temperature casts and anomalous reflectance caused by a combination of certain dyes and materials. It is sometimes impossible to photographically record the exact colour as seen by the human eye.

5. Creative Licence – The photographer shall be granted creative and artistic licence in relation to poses and the locations used. The style and number of photographs taken by the photographer shall be deemed correct, but can be dependant upon the vagaries of the weather and the availability and willingness of the clients and their guests. This applies to products ordered as well. The photographer will do their best to honour requests but does not guarantee these nor incorporate any specific background, location or group arrangement.

6. Display – The client will be able to choose how and where the images created from within this photoshoot are used by the photographer, during the client studio viewing session via the GDPR form which sets out clear usage options.

7. Copyright – The photographer retains full copyright of all images under this contract.

8. Licensed Images – Any digital images supplied to the client are licensed for personal printing, sharing or displaying electronically with their family and friends.

9. Third Party Printing – The photographer cannot accept responsibility or liability for colour balance or quality of any products from third party printers, such as high street photo processing shops, produced from the supplied digital images.

10. Force Majeure – Whilst every care is taken, this contract is subject to alteration or cancellation by the photographer owing to any unforeseeable circumstances beyond their reasonable control e.g. acts of God, fire, war etc.

11. Attendance – In the unlikely event off the assigned photographer being unable to cover your event due to unforeseen circumstances, the photographer reserves the right to appoint another photographer to fulfil this contract to the best of their ability.

12. Limitations of Liability – In the unlikely event of total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

13. Cancellation – If the photographer has to cancel this contract at any time due to circumstances beyond control (e.g. death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid by the client. The client may cancel this contract at any time by giving written notice to the photographer but in doing so shall forfeit monies paid.

14. Product Substitution – In the unlikely event that a supplier ceases production of a product, the photographer reserves the right to offer a suitable alternative, one of similar value, or if necessary, from another supplier.

15. Viewing and Ordering Session – When your photos are ready for viewing and presentation, the photographer will contact you to arrange your Viewing and Ordering Session. Attending this session is a compulsory part of the process.

16. Ordered products will be available for pick up from the photographers studio office address. A delivery charge of £20 will be applicable if the client wants the order posted to their address.
